Privacy policy

1. Who we are and what this covers

This Privacy Policy explains what personal information Tournesol collects, how we use it, and the choices you have. It applies to our website at tournesol.com and to our sales and service communications (phone and email). Text messages and our SMS program are described in our SMS Terms & Conditions.

Tournesol is operated by Tournesol Siteworks LLC, 32990 Alvarado-Niles Rd, Suite 990, Union City, CA 94587. We manufacture and sell our own products to designers, contractors, and other business customers in the United States.

2. Information we collect

We collect only what we need to quote, build, deliver, and support your project:

  • Contact details: your name, mobile and other phone numbers, email address, and billing and shipping addresses.
  • Account information: if you create an account on our online store; your username, password, security questions, and preferences and settings.
  • Order and transaction information: the items you view, add to your cart or wishlist, purchase, return, exchange, or cancel; your past orders; billing and shipping addresses; and transaction details such as payment confirmation.
  • Business details: your company name and role, if you are a contractor or business customer.
  • Project information: quotes, orders, specifications, delivery or job-site addresses, and the content of our messages with you, including texts.
  • Website data: technical information collected automatically, such as IP address, browser type and language, device and operating system, referring pages, pages visited, and date and time of visit, collected through cookies and similar tools on our website, which is Shopify hosted.

We do not collect or store Social Security numbers. Payment card payments are handled by our payment processors: Shopify Payments for orders on our online store, and PayTrace for orders placed outside the website. Card details are entered into those processors' systems and are subject to their privacy policies. We do not store card numbers in our CRM or other records. Please do not send card or Social Security numbers to us by text or email.

We collect information directly from you, for example when you contact us, request a quote, fill in a form, or give us your number to text.

We may also receive limited information from third parties, such as social media platforms when you interact with our pages, and advertising and analytics providers.

3. How we use and keep your information

We use your information to:

  • Prepare quotes and fulfill orders and projects.
  • Communicate with you by phone, email, or text, using your preferred channel.
  • Provide support, warranty service, and follow-up after your project.
  • Contact you about future projects you have shown interest in.
  • Meet legal, tax, and accounting obligations.
  • Create and manage your online account: process orders, returns, and exchanges; arrange shipping; and suggest products related to your purchases.
  • Protect accounts and payments and detect, investigate, or act on fraud or other unauthorized activity.
  • Understand how our website is used, improve it, and measure and deliver our online advertising.

Your information is stored in our customer relationship management (CRM) system and may be used for future projects with you. We keep personal information as long as we need it for the purposes in this policy, unless the law requires or permits a longer period. How long depends on:

  • Whether we still have an active relationship with you or an open project.
  • Our legal obligations, such as tax and accounting rules.
  • Whether we need the information to resolve disputes, handle warranty claims, or enforce our agreements.
  • How sensitive the information is and the security risk of keeping it.

When information is no longer needed, we securely delete or anonymize it. You can ask us to delete it at any time (see section 7).

Newsletter and marketing email. If you sign up for our newsletter, we will use your email address to send news about our collections, projects, and products. You can unsubscribe at any time using the link in any email. Text messaging is separate: we use it only for conversations about your quote, order, or project, and never for marketing.

Keeping your details accurate. Please tell us promptly if your name, phone number, email address, or other details change, so we can keep our records up to date.

Employee text programs. Tournesol also runs a voluntary text-message program for employees at our Port Orchard, Washington, and Jurupa Valley, California, facilities, covering facility alerts and absence reporting. It is governed by our Employee SMS Terms. This policy covers customers and website visitors; employee information is handled under our internal employment policies.

4. Sharing your information

We do not sell your personal information for money. Like most websites, we use advertising and analytics cookies that share limited website activity data with advertising partners (see section 5). Some state laws treat this as “sharing” for targeted advertising or as a “sale,” and you can opt out as described in section 5.

No sharing of customer information for marketing. We do not share your information, including e-mail addresses and mobile numbers with any third party or affiliate for marketing or promotional purposes. This includes all information gathered through our SMS program.

We share information only in these limited cases:

  • Service providers that help us run our business under confidentiality obligations, such as our CRM, messaging platform, email, website hosting, payment processors (Shopify Payments and PayTrace), and shipping or installation partners. They may use your information only to provide services to us.
  • Legal and safety reasons, such as responding to a lawful request or protecting our rights.
  • A business transfer, such as a merger or sale of the company, in which case your information would remain subject to this policy.
  • Advertising and analytics partners, such as Google, through cookies and pixels on our website, to measure website use and show relevant ads. This covers website activity only. We do not share your phone number, text messages, or SMS consent for these purposes. Under some state laws, this may count as "sharing" personal information; see section 5 for your choices.

Shopify. Our website and online store are hosted by Shopify, which collects and processes information about how you access and use them in order to provide and improve our services. Information you submit may be transmitted to Shopify and to service providers in countries other than where you live. We also use certain Shopify features that draw on information from your interactions with our store, with other merchants, and with Shopify. For those uses, Shopify is responsible for processing your information, including responding to your rights requests. If you pay with Shop Pay, Shopify handles your payment and account information under its own privacy policy. To learn more, or to exercise rights over data Shopify controls, see the Shopify Consumer Privacy Policy at https://privacy.shopify.com/en.

5. Cookies and website tracking

Our website, hosted by Shopify, uses cookies, pixels, and similar technologies in four ways:

  • Required: These cookies are necessary for the site to function properly, including capabilities like logging in and adding items to the cart. These cannot be turned off.
  • Personalization: These cookies store details about your actions to personalize your next visit to the website.
  • Marketing: These cookies are used by our partners, including Shopify and us, to optimize marketing communications and show you ads on other websites.
  • Analytics: These cookies help us understand how you interact with the site. We use this data to identify areas to improve.

You can manage cookies on our website at the bottom of the profile page, ‘cookie preferences’. Blocking some cookies may affect parts of the site. To opt out of Google Analytics, use Google's opt-out browser add-on. We honor the Global Privacy Control browser signal where the law requires.

Targeted advertising. We use Shopify and third-party advertising services, such as Google, to measure our ads and show you relevant ads. These services receive information about your activity on our website, such as pages viewed and items added to your cart, and may combine it with activity from other websites. We do not share your phone number, your text messages, or your SMS consent with them for this purpose. Depending on where you live, you can opt out by using the “Your Privacy Choices” link on our website, declining non-essential cookies in our cookie banner, or using a browser setting or extension that sends the Global Privacy Control signal. You can also contact us using the details in section 7.

7. Your choices, security, and contact

Your rights and choices. Depending on where you live, you may have some or all of these rights over your personal information: to know what we collect and how we use and disclose it; to access a copy; to correct inaccurate information; to delete information; to receive your information in a portable format; and to opt out of the “sale” or “sharing” of your information for targeted advertising. These rights are not absolute, and we may decline a request where the law allows.

To make a request, call 800-542-2282 or email info@tournesol.com with “Privacy Inquiries” in the subject line. We may need to verify your identity first. We will not discriminate against you for exercising your rights.

If you disagree with our decision on a request, you may appeal by contacting us at the same details, and you may also file a complaint with your state attorney general or other privacy regulator.

Your choices. To stop text messages, reply STOP to any message. To stop emails, use the unsubscribe link or tell us. To limit advertising and analytics cookies, see section 5. Contact us using the details below, and we will respond within a reasonable time. Residents of some states have additional rights under state privacy laws, and we will honor valid requests.

Security. We use reasonable administrative, technical, and physical safeguards to protect your information. No method of storage or transmission is completely secure, so we cannot guarantee absolute security. Email and text messages are not encrypted, so please do not send sensitive information that way. If a data breach requires notice under the law, we will notify affected individuals and authorities as required.

Children. Our website and services are not directed to children under 13, and we do not knowingly collect their information.

Other websites. Our website may link to sites we do not run. This policy does not apply to them, so please read their privacy policies.

Changes. We may update this policy from time to time. The current version is always posted at tournesol.com/policies/privacy-policy with its effective date.
